Please read these Terms of Service (“Terms”) carefully before using the Rite Aid platform. These Terms constitute a legally binding agreement between you and Rite Aid LLC.

ARBITRATION NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER IN SECTION 14. BY AGREEING TO THESE TERMS, YOU AGREE TO RESOLVE DISPUTES THROUGH INDIVIDUAL BINDING ARBITRATION AND WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS OF ACCEPTING THESE TERMS BY FOLLOWING THE PROCEDURE IN SECTION 14.8.

1. Agreement to Terms
By creating an account, purchasing a membership, or otherwise accessing or using the Rite Aid platform, website (riteaid.com), mobile applications, or related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).
If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and “you” refers to both you individually and the organization.
If you do not agree to these Terms, do not access or use the Service.
These Terms incorporate by reference our Privacy Policy, which describes how we collect, use, and protect your personal and health information.
2. Service Description
Rite Aid provides a direct-to-consumer platform for ordering and receiving laboratory tests and personalized health insights. The Service includes:
- Access to a panel of blood tests covering key biomarkers for heart health, metabolic function, hormones, vitamins, and other health markers.
- Review and authorization of lab orders by independent licensed physicians.
- Test fulfillment through CLIA-certified laboratory partners (such as Quest Diagnostics and Labcorp).
- Secure online access to your lab results through your account dashboard.
- Personalized health insights and educational content based on your results.
- Historical tracking of your lab results over time.
The Service is not a substitute for a primary care physician or regular medical care. See Section 7 for important medical disclaimers.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age.
- Be a legal resident of the United States.
- Have the legal capacity to enter into a binding contract.
- Not be barred from using the Service under applicable law.
By using the Service, you represent and warrant that you meet all eligibility requirements.
Certain lab tests may have additional eligibility requirements or may not be available in all states due to regulatory restrictions. We will notify you if a requested test is unavailable in your location.
4. Account Registration
4.1 Account Creation
To access the Service, you must create an account and provide accurate, complete, and current information, including your legal name, date of birth, email address, phone number, and mailing address. You agree to update this information promptly if it changes.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized access or security breach.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
4.3 One Account Per Person
Each individual may maintain only one account. You may not create an account on behalf of another person (except for legal dependents where permitted by law).
5. Membership and Pricing
5.1 Pricing
The prices for lab tests and membership plans are displayed on the Service at the time of purchase. All prices are in U.S. dollars and are subject to change without prior notice. Price changes will not affect orders that have already been placed.
5.2 Membership Plans
If you purchase a membership or subscription plan:
- Memberships automatically renew at the end of each billing period unless cancelled.
- You will receive a reminder email at least 14 days before any automatic renewal.
- You may cancel your membership at any time through your account settings or by contacting us.
- Cancellation will take effect at the end of the current billing period; you will retain access until then.
5.3 Payment
Payment is due at the time of purchase. We accept major credit cards, PayPal, and other payment methods as displayed at checkout. All payments are processed through secure third-party payment processors (such as Stripe and PayPal). We do not store your full payment card details on our servers.
By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us to charge the applicable fees.
5.4 Refund Policy
- Before Lab Visit: If you have not yet completed your lab visit, you may request a full refund within 30 days of purchase.
- After Lab Visit: Once lab work has been performed, refunds are not available, as the service has been rendered.
- Membership Refunds: For membership plans, if you cancel within 30 days of initial purchase and have not used any membership benefits, you may request a full refund. After 30 days, no refunds will be issued for the current billing period.

6. Lab Testing and Results
6.1 Physician Authorization
All lab tests ordered through the Service are reviewed and authorized by independent licensed physicians. By using the Service, you consent to this physician review and authorization process.
6.2 Laboratory Partners
Lab tests are performed by CLIA-certified, state-licensed laboratories. We currently partner with Quest Diagnostics, Labcorp, and other certified laboratories. The specific laboratory used may vary based on your location and the tests ordered.
6.3 Lab Visits
After your order is processed and approved by a physician, you will receive instructions for visiting a designated patient service center (blood draw location). You are responsible for scheduling and attending your lab appointment.
6.4 Results Delivery
Lab results are typically available within 2–7 business days after your lab visit, depending on the tests ordered. Results are delivered through your secure online account dashboard. You will receive a notification when your results are ready.
Turnaround times are estimates and may vary. We are not responsible for delays caused by laboratories, shipping, or other factors outside our control.
6.5 Critical Results
If your lab results indicate a potentially serious health condition, we may attempt to contact you directly by phone or email in addition to posting results to your dashboard. However, you are responsible for checking your results and following up with a healthcare provider.
7. Medical Disclaimer and Limitations
7.1 Not Medical Advice
THE SERVICE, INCLUDING LAB RESULTS, HEALTH INSIGHTS, AND ALL CONTENT PROVIDED THROUGH THE SERVICE, IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THE SERVICE IS NOT INTENDED TO BE, AND SHOULD NOT BE USED AS, A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
7.2 No Doctor-Patient Relationship
Use of the Service does not create a doctor-patient relationship between you and Rite Aid LLC or any of its employees or contractors. The independent physicians who authorize lab orders do so for the limited purpose of ordering laboratory tests and are not providing ongoing medical care.
7.3 Consult Your Healthcare Provider
Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or your lab results. Never disregard professional medical advice or delay seeking it because of information obtained through the Service.
If you experience a medical emergency, call 911 or go to the nearest emergency room immediately.
7.4 No Guarantee of Accuracy
While we strive to provide accurate information and work with certified laboratories, we do not guarantee that lab results or health insights are error-free. Lab results can be affected by many factors, including sample collection, transportation, and individual biological variation.
7.5 Limitations on Use
The Service is not designed for and should not be used to:
- Diagnose, treat, cure, or prevent any disease or medical condition.
- Make medical decisions without consulting a qualified healthcare provider.
- Replace regular check-ups with your primary care physician.
- Monitor acute or emergency medical conditions.
7.6 Assumption of Risk
You assume full responsibility for how you choose to use the information provided through the Service. You acknowledge that decisions about your health are your responsibility and should be made in consultation with qualified healthcare professionals.
8. Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and disclosure of your personal and health information as described in the Privacy Policy.
Health Information Consent: By using the Service to order lab tests, you expressly consent to our collection, storage, and processing of your health information, including lab results, as necessary to provide the Service.
9. Intellectual Property
9.1 Our Intellectual Property
All content, features, and functionality of the Service, including text, graphics, logos, icons, images, software, and the overall design and arrangement thereof, are owned by Rite Aid LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.
“Rite Aid” and related logos and trademarks are trademarks of Rite Aid LLC. You may not use our trademarks without our prior written consent.
9.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
9.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service for any commercial purpose without our prior written consent.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
10. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Provide false, misleading, or inaccurate information.
- Share your account credentials with third parties or allow others to access your account.
- Attempt to gain unauthorized access to the Service, other accounts, or computer systems.
- Use the Service to provide medical advice to others.
- Interfere with or disrupt the integrity, security, or performance of the Service.
- Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent.
- Harass, abuse, or harm other users or our staff.
- Upload or transmit viruses, malware, or other malicious code.
We reserve the right to suspend or terminate your account for violations of these Terms.
11. Text Messaging and Communications
11.1 Consent to Text Messages
By providing your mobile phone number and opting in to text message communications, you consent to receive text messages (SMS and MMS) from Rite Aid LLC at the phone number you provided. Message types may include:
- Service Messages: Lab result notifications, appointment reminders, order confirmations, and account alerts.
- Promotional Messages: Special offers, discounts, and marketing communications (if you opt in separately).
11.2 Message Frequency and Rates
Message frequency varies based on your activity and preferences. Message and data rates may apply. Consult your mobile carrier for details about your plan.
11.3 Opt-Out
You may opt out of text messages at any time by:
- Replying “STOP” to any text message from us.
- Adjusting your communication preferences in your account settings.
- Contacting us at [email protected].
Opting out of promotional messages will not affect service-related messages necessary for your orders.
11.4 Help
For help with text messages, reply “HELP” to any message or contact us at [email protected].
11.5 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. We are not responsible for messages that are not received due to carrier issues, changes to your phone number, or other factors outside our control.
12. Limitation of Liability
12.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RITE AID LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- Results obtained through the Service will be accurate or reliable.
- Any errors in the Service will be corrected.
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RITE AID LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of:
- The amounts paid by you to Rite Aid LLC in the twelve (12) months preceding the claim, or
- One hundred dollars ($100).
12.3 Basis of the Bargain
The limitations in this Section 12 reflect the allocation of risk between you and Rite Aid LLC and are an essential basis of the bargain between us. The Service would not be provided without these limitations.
12.4 Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.
13. Indemnification
You agree to indemnify, defend, and hold harmless Rite Aid LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Any content you submit or transmit through the Service.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
14. Dispute Resolution, Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
14.1 Informal Resolution First
Before initiating any arbitration or court proceeding, you agree to first contact us at [email protected] and attempt to resolve any dispute informally for at least 60 days. Most disputes can be resolved this way.
14.2 Agreement to Arbitrate
If we cannot resolve a dispute informally, you and Rite Aid LLC agree to resolve any disputes, claims, or controversies arising out of or relating to these Terms or the Service through binding individual arbitration, rather than in court, except as provided in Section 14.7.
This agreement to arbitrate is intended to be interpreted broadly and includes, but is not limited to:
- Claims arising out of or relating to any aspect of the relationship between you and Rite Aid LLC.
- Claims that arose before these Terms or any prior agreement.
- Claims that arise after termination of these Terms.
14.3 Arbitration Rules and Procedures
Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, which are available at www.adr.org. If AAA is unavailable, the parties shall mutually agree on an alternative arbitration provider.
- Filing: To initiate arbitration, you must send a written demand to our address in Section 18.
- Location: Arbitration hearings will take place at a location mutually agreed upon by the parties, or via videoconference if the parties agree or the arbitrator determines it appropriate.
- Arbitrator: The arbitration will be conducted by a single neutral arbitrator.
- Fees: If you initiate arbitration, you will pay the consumer filing fee required by AAA (currently $200). We will pay all remaining AAA fees. If we initiate arbitration, we will pay all fees.
- Decision: The arbitrator’s decision will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
14.4 Class Action Waiver
YOU AND RITE AID LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class, collective, or representative proceeding.
If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void, and the dispute shall proceed in court.
14.5 Mass Arbitration Procedures
If 25 or more claimants submit demands for arbitration raising substantially similar claims, and are represented by the same or coordinated counsel, these shall be considered “Mass Arbitration Claims.” For Mass Arbitration Claims:
- Counsel for the parties shall meet and confer to discuss resolution.
- If not resolved, batches of 10 claims shall be selected for arbitration at a time.
- The results of the initial batch shall inform resolution of remaining claims.
- No further arbitrations shall be filed until the batch process concludes.
14.6 Exceptions to Arbitration
The following claims are not subject to arbitration:
- Claims in small claims court, if the claim qualifies.
- Claims for injunctive relief to stop unauthorized use or abuse of the Service or intellectual property infringement.
14.7 Jury Trial Waiver
If for any reason a claim proceeds in court rather than arbitration, YOU AND RITE AID LLC WAIVE ANY RIGHT TO A JURY TRIAL.
14.8 Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to us within 30 days of first accepting these Terms. Your notice must include:
- Your name and address.
- Your email address and phone number associated with your account.
- A clear statement that you wish to opt out of the arbitration agreement.

If you opt out, you may still use the Service, and all other provisions of these Terms will remain in effect.
14.9 Survival
This arbitration agreement shall survive termination of your account and these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
For any claims not subject to arbitration, you agree to submit to the personal jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
16. Termination
16.1 Termination by You
You may terminate your account at any time by contacting us at [email protected] or through your account settings. Upon termination:
- Your access to the Service will cease.
- You will remain responsible for any outstanding charges.
- We will retain your data as described in our Privacy Policy.
16.2 Termination by Us
We may suspend or terminate your account at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination:
- Your right to use the Service will immediately cease.
- We may delete your account and data, subject to our Privacy Policy and legal requirements.
16.3 Survival
The following sections shall survive termination: Section 7 (Medical Disclaimer), Section 9 (Intellectual Property), Section 12 (Limitation of Liability), Section 13 (Indemnification), Section 14 (Dispute Resolution), Section 15 (Governing Law), and this Section 16.3.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Rite Aid LLC concerning the Service.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
17.5 Notices
We may provide notices to you via email, through the Service, or by posting on our website. You agree that electronic notices satisfy any legal requirement that notices be in writing.
17.6 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, pandemic, or internet or telecommunications failures.
17.7 Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email (if you have an account) or by posting a prominent notice on the Service at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
